- This User Agreement constitutes a binding contract between you and FOMO Spills governing your access to and use of SpillHub.
- You must be at least 13 years of age (or the minimum legal age required in your country) to create an account.
- You retain intellectual property ownership of the content, posts, and media you submit to SpillHub. You grant SpillHub a worldwide, non-exclusive license to host, display, and distribute your content across our platform and edge network.
- You are responsible for your account credentials, your interactions with other community members, and compliance with all applicable local, national, and international laws.
- Harassment, vote manipulation, automated botting, unsolicited spam, unauthorized scraping, and illegal activities are strictly forbidden and subject to immediate suspension.
1. Acceptance of Terms
Please review this User Agreement ('Agreement', 'Terms') carefully. This Agreement is a legally binding contract between you ('User', 'you', or 'your') and FOMO Spills ('SpillHub', 'FOMO Spills', 'we', 'us', or 'our'), governing your access to and use of the SpillHub website (fomospills.com, fomospills.in), web applications, developer APIs, creator dashboards, and related services (collectively, the 'Services').
By clicking 'Sign Up', 'Log In', 'Continue with Google', 'Continue with Apple', or by otherwise accessing or using our Services, you represent and warrant that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, our Community Rules, and our Moderator Code of Conduct. If you do not agree, you must not access or use the Services.
2. Eligibility & Capacity
You must be at least thirteen (13) years of age to access or use the Services. If the laws of your jurisdiction require that you must be older in order for SpillHub to lawfully provide the Services to you without parental consent (including processing your personal data), then you must have reached that minimum statutory age.
If you are accepting these Terms on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to bind that entity to this Agreement, in which case 'you' and 'your' will refer to that entity.
You further represent that you are not prohibited from receiving the Services under applicable trade sanctions, embargoes, or export control laws.
3. Your Account & Creator Credentials
To publish posts, submit comments, join communities, or curate a subreddit-style community ('r/[slug]'), you must register for an authenticated SpillHub account. When registering, you agree to:
- Select a unique creator handle conforming to our platform syntax requirements (3 to 32 alphanumeric characters and underscores: ^[a-z0-9_]{3,32}$).
- Maintain the absolute confidentiality of your authentication credentials, passwords, and magic login links.
- Never sell, transfer, license, or assign your handle, account, or karma status to any third party without our explicit written consent.
- Never impersonate any individual, creator, brand, entity, or public figure in a manner that deceives or misleads community members.
- Promptly notify support@fomospills.in if you discover or suspect any unauthorized access to or security breach of your account.
4. Permitted Use & Code of Conduct
SpillHub grants you a personal, non-transferable, non-exclusive, revocable, and limited license to access and use the Services for personal, non-commercial discussion or legitimate creator community engagement, strictly subject to this Agreement.
You agree that you will NOT engage in any of the following prohibited activities:
- Vote Manipulation & Sybil Attacks: Creating multiple accounts, utilizing automated bots, or orchestrating vote-trading networks to artificially inflate or deflate post scores or karma balances.
- Harassment & Brigading: Coordinating targeted harassment, dox attacks, stalking, hate speech, or brigading against specific communities, moderators, or individual creators.
- Scraping & Unauthorized Ingestion: Extracting, harvesting, scraping, or caching platform data, posts, or comment trees via automated means (scripts, scrapers, crawlers) without an official API key or written authorization.
- Artificial Intelligence Ingestion: Ingesting SpillHub content, comments, or creator media to train, fine-tune, or benchmark commercial Large Language Models (LLMs) or generative AI systems without an express written enterprise licensing agreement with FOMO Spills.
- Infrastructure Interference: Circumventing rate limits, overwhelming edge servers with distributed denial-of-service (DDoS) traffic, probing network vulnerabilities, or reverse engineering client applications.
5. Your Content & Intellectual Property License
You retain all intellectual property rights, ownership, and copyright in the content you create and submit to SpillHub, including textual posts ('Spills'), rich markdown descriptions, embedded media, and nested discussion comments ('Your Content').
By submitting Your Content to public communities on SpillHub, you grant FOMO Spills a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works of, format, publish, publicly display, distribute, and broadcast Your Content in any media, platform, or distribution channel now known or hereafter developed.
This license enables us to deliver your content globally across our edge network, generate dynamic previews, format responsive UI layouts across mobile and desktop devices, render RSS/API feeds, and syndicate community highlights.
You represent and warrant that you possess all necessary rights, licenses, consents, and permissions to submit Your Content and to grant the rights granted herein, and that Your Content does not violate any third-party intellectual property, privacy, or publicity rights.
6. Third-Party Content & External Hyperlinks
The Services contain user-generated submissions, third-party hyperlinks, and embedded multimedia. FOMO Spills does not pre-screen, endorse, sponsor, or assume legal responsibility for any third-party content, external websites, or resources.
When you follow a hyperlink or interact with an external third-party service, you do so entirely at your own risk. Third-party services are governed by their respective terms of service and privacy practices.
7. Community Moderation & Creator Governance
SpillHub relies on a distributed governance model wherein authorized users may establish and curate distinct communities ('r/[slug]').
Volunteer Moderators: Moderators are independent, volunteer community custodians. They are not employees, agents, or contractors of FOMO Spills. Moderators must adhere to our Moderator Code of Conduct and enforce community rules fairly and transparently.
Platform Interventions: FOMO Spills reserves the absolute right, but does not assume the obligation, to review, flag, quarantine, remove, or modify any post, comment, or community that violates this Agreement, our Community Rules, or applicable law, and to suspend or terminate moderator status or account privileges at our sole discretion.
8. Copyright Infringement & DMCA Takedown Policy
FOMO Spills respects the intellectual property rights of others and responds promptly to notices of alleged copyright infringement complying with the Digital Millennium Copyright Act (17 U.S.C. § 512, 'DMCA') and India's Copyright Act, 1957.
Designated Copyright Agent Notice Requirements: If you believe in good faith that your copyrighted work has been reproduced or distributed on SpillHub in a manner constituting copyright infringement, please submit a written notification to our Designated Copyright Agent at support@fomospills.in containing:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or a representative list of works.
- Identification of the material claimed to be infringing, including the specific SpillHub URL (/post/[id] or /r/[slug]).
- Sufficient contact information: full name, physical mailing address, telephone number, and email address.
- A statement of good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act.
9. Creator Verification & Monetization Standards
SpillHub empowers verified creators to build audience trust and showcase authentic milestones within the FOMO Spills ecosystem.
Verification Integrity: Any creator seeking or displaying verified badges must provide truthful, verifiable credentials. Fabricating revenue metrics, subscriber counts, investment rounds, or partnership endorsements is considered fraudulent conduct and grounds for immediate, permanent platform expulsion.
Commercial Disclosures: In compliance with the Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials in Advertising and India's Advertising Standards Council of India (ASCI) Guidelines, creators must clearly and conspicuously disclose any material commercial connections, sponsored relationships, or affiliate compensation in all relevant posts.
10. Warranties & Statutory Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT, SUBMISSIONS, FEEDS, AND CODE ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
FOMO SPILLS EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE SECURE, ERROR-FREE, FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT ANY CONTENT OR METRICS ARE ACCURATE OR RELIABLE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOMO SPILLS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO ACCESS THE SERVICES.
UNDER NO CIRCUMSTANCES SHALL FOMO SPILLS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID TO FOMO SPILLS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FOMO Spills, its parent, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) Your Content; (c) your breach of this Agreement; or (d) your violation of any third-party right, including intellectual property or privacy rights.
13. Dispute Resolution, Governing Law & Jurisdiction
Informal Resolution: Before initiating any formal legal proceeding, you and FOMO Spills agree to attempt to resolve any dispute, claim, or controversy informally for at least thirty (30) days by contacting support@fomospills.in with a detailed description of the dispute.
Governing Law: If you reside in India or outside the United States and the European Economic Area, this Agreement and any dispute arising hereunder shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You and FOMO Spills agree to submit to the exclusive jurisdiction of the competent courts situated in Mumbai, Maharashtra, India.
For users residing in the United States, this Agreement is governed by the laws of the State of California, and disputes shall be resolved in the state or federal courts located in San Francisco County, California.
For users residing in the EEA, UK, or Switzerland, mandatory consumer protection provisions of the law of your country of residence shall apply.
14. Termination, Severability & Entire Agreement
Termination: You may terminate this Agreement at any time by ceasing all use of the Services and deleting your account. We may suspend or terminate your account or access to the Services at any time, with or without notice, for conduct that violates this Agreement, our rules, or applicable law.
Survival: All provisions of this Agreement which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Severability: If any provision of this Agreement is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Entire Agreement: This Agreement, together with our Privacy Policy and Community Rules, constitutes the entire agreement between you and FOMO Spills regarding the Services.
